In consideration of being permitted to participate in any way in the Tiger's Eye Karate-Do Academy program indicated below and/or be permitted to enter for any purpose any restricted area (herein defined at any area where admittance to the general public prohibited) the parent(s) of the minor participant named below agree: 

The use of the term student is referring to anyone who participates in Training with Tiger's Eye Karate-Do Academy, which could be a child, or an adult, male or female.

1.0: observation of rules
The student agrees to observe all club rules, bylaws, policies, and regulations. And understand that these are established to maintain class order and to minimize the chance of personal injury.

2.0: Attendance and punctuality
It is of the utmost importance that the student is punctual to each lesson. If it is your child that is training, and they arrive before the instructor has arrived on-site, it is required that you please remain with them until a member of staff is present. Until a member of staff is on-site you are responsible for their safety and well-being. Should you choose to leave them unattended, we hold no responsibility for them. It is also important that you arrive promptly and on time to collect your child. Many of our instructors have other classes to teach and need to leave immediately after the class. By agreeing to these Terms and Conditions, it is agreed that should you drop your child early to their lesson, you are responsible for your child until lessons begin, and that Tiger's Eye Karate-Do Academy and its owners, operators, officers, employees, instructors, students, or agents hold no responsibility over your child until the lesson has begun and they are in the training room with the instructor.

3.0: Change of location and time.
Tiger Martial Arts reserves the right to change the time or location of any class for any reason. By agreeing to these Terms and Conditions, it is understood that changes may be made to the location and time of classes.

4.0: Payment
4.1: Monthly fees are payable on the 1st or the 15th of the month and must be paid in advance. The payment is subject to a $20.00 late payment charge if paid more than 3 days past the agreed day of payment. An NSF charge of $45.00 shall be levied on dishonoured cheques.

4.2: There may be additional fees payable for ranking examinations and Karate B.C. Membership.

4.3: Fees can be waived for up to one month to account for vacation absence in case of yearly membership only.

4.4: Should you refuse to pay within one month then you forfeit the student’s right to participate in training, and the student will unfortunately not be allowed to train with us until all payments and fees have been paid. By agreeing to these terms and conditions, I hereby agree that Tiger's Eye Karate-Do Academy has the right to refuse service to those who are not up to date with payments, as well as for those who continually make late payments.

4.5: In the event of non-payment of fees or a default thereof, the balance of the fees, calculated as per the terms of this agreement, shall become due and payable, and Applicant / Parent / Guardian agrees to pay interest at the rate of 24% per annum (2% per month) plus all costs of collection, calculated on a solicitor/client basis, to the order of Tiger's Eye Karate-Do.

5.0: Disobedience
We reserve the right to discontinue training for any student that we deem as persistently disobedient. Should we feel we are unable to control the student’s behavior, and that the child’s behavior is detrimental to the other student's training, then we will be in contact and the student will be dismissed from further lessons. Discipline is embedded in the culture of Karate and is required for training. By agreeing to these Terms and Conditions, I hereby understand that should a student's behavior be uncontrollable, then they will be dismissed from future lessons.

6.0: Image Consent
We would like to take pictures, and occasionally video the students performing their Martial Arts for promotional materials, publications in print material, Website, and advertising purposes. The photos will always be appropriate, and available for the customer to view upon request. The images, be they photo or video, will be stored in a safe and secure place. I hereby grant permission to Tiger's Eye Karate-Do Academy the use of the student’s image, likeness, and voice, recorded in digital format, during regular classes and special events without payment. I understand the images and film may be edited, exhibited, and distributed through any media that Tiger's Eye Karate-Do Academy sees fit and I waive any rights of compensation or ownership thereto.

7.0: Personal Belongings
We cannot be held responsible for any personal belongings lost or stolen during a training session. It is strongly advised that anything of value be left at home.

8.0: Health and Safety
Should the student suffer from any of the following medical problems, please consult with your doctor to ensure that intense physical exercise will not pose a problem to the student. In addition, please inform us via email so that we may take note. We must be informed of any conditions before any instruction is carried out.
• Back problems
• Any illness or injury that may be aggravated by exercise
• Head injuries
• Dizziness, or loss of unconsciousness during exercise
• High cholesterol
• Joint problems, such as arthritis, that is aggravated by exercise
• Chest pains when exercising
• Any prescription medication being taken
• A heart condition
• Any conditions that restrict blood flow
• Diabetes or any other metabolic diseases
• High or low blood pressure

8.1: Should the student suffer from anything on this list, please inform the instructor immediately to discuss what action should be taken to ensure safety and well-being. It is advised that you consult a doctor if you suffer from any of these conditions before participating to ensure it is safe.

8.2: By agreeing to these terms and conditions, I agree that I have consulted a doctor recently and the doctor has agreed it is safe. I also agree that I have informed the instructor or Tiger's Eye Karate-Do Academy of any medical problem the student has and that I choose to let the student continue in this class at my own risk. I also agree that I understand fully that the student will be participating in a semi-contact sport. I hereby agree that I would like the student to participate in what can be intense physical exercise, including, but not limited to, running, stretching, aerobic and resistance exercise, all of which can result in injury or in incredibly unlikely circumstances, death.

8.3: Grant permission in case of injury to have a Doctor, Nurse, Athletic trainer, or other emergencies medical personnel provides the student with medical assistance or treatment for such injury.

9.0: Liability Waiver
I hereby agree that I have discussed any health problems with an instructor. I agree that I hold responsibility for any unlikely injury to the student and that the owners, operators, officers, employees, instructors, students, or agents at Tiger Martial Arts cannot be held responsible for these injuries.

10.0: Sparring Gear (Protective gear)
It is mandatory that all Tiger's Eye Karate-Do Academy students purchase the required sparring gear which includes hand footgear and mouth guard (groin cup for males) upon achieving the level of the yellow belt. Failure in meeting this requirement will see the student dismissed from sparring until the sparring gear is purchased.
The sparring gear is available on the Tiger's Eye Karate-Do Academy.
Students are required to take care of their sparring gear and keep it in good operable condition. Sparring gear that is lost, torn or damaged in any way must be replaced immediately. Only recognized high-quality mouth guards will be permitted to be used in class.

10.1: The parent(s) or legal guardian(s) of minors will instruct the minor participants that prior to participating in the below karate/self-defence activity or event, he /she will inspect the facilities and equipment to be used, and if he/she believes anything is unsafe, the participant will immediately advise the officials of such condition and refuse to participate. The participant understands and agrees that, if at any time, he/she feels anything to be unsafe, he/she will immediately take all precautions to avoid the unsafe area and refuse to participate further.

Event Participation Waiver

WAIVER OF LIABILITY FOR ALL CLAIMS AND RELEASE OF LIABILITY

PLEASE READ CAREFULLY BEFORE AGREEING.

This waiver does not affect accident and out-of-country travel insurance provided by the Tiger's Eye Karate-Do where applicable.

By signing below, the Participant and/or the Participant’s Guardian represents that the Participant:

  • Has not travelled internationally during the last 14 days;
  • Does not knowingly have COVID-19;
  • Is not experiencing any known symptoms of COVID-19, such as fever, cough, difficulty breathing, or shortness of breath, and if experiences such symptoms during the Event will immediately depart from the Event;
  • Has not, in the past 14 days, knowingly come into contact with someone who has COVID-19, who has any known symptoms of COVID-19, or is self-quarantining after returning to Canada; and
  • Follows government recommended guidelines in respect of COVID-19, including practicing physical distancing, and will do so to the best of the Participant’s ability during the Event.

In addition, by agreeing below the Participant and/or the Participant’s Guardian understands, acknowledges and assumes the inherent risks in participating in the Event, including, but not limited to:

  • The potential for bodily injury or illness (including contraction of COVID-19);
  • Contact or interaction with others who may have been exposed to COVID-19;
  • Permanent disability, paralysis, or loss of life;
  • Collision with natural or manmade objects;
  • Dangers arising from adverse weather conditions;
  • Imperfect venue or field of play conditions;
  • Equipment failure;
  • Participants of varying skill levels;
  • Inadequate safety measures;
  • Circumstances known, unknown or beyond the control of the Organizer, its partners, Sponsors, agents, affiliates, directors, employees, officer, therapists, or volunteers (together, the “Organization”); and
  • Negligence or omission of the Organization

(collectively, the “Risks”).

In consideration for allowing the Participant to participate in the Event, the Participant and/or the Participant’s Guardian:

(a) release, discharge and forever hold harmless the Organization from any and all liability for damages or loss arising as a result of the Risks of participation in or in connection with the Event.

(b) waive any right to sue the Organization in respect of all causes of action (including for injuries or illness caused by their own negligence), claims, demands, damages or losses of any kind that may arise as a result of the Risks of participation in or in connection with the Event, including without limitation the right to make a third party claim or claim over against the Organization arising from the same; and

(c) freely assumes all risks associated with the Risks, anything incidental to the Risks, which may arise as a result of participation in or in connection with the Event.

YOU ARE GIVING UP LEGAL RIGHTS TO ANY AND ALL FUTURE CLAIMS AGAINST THE ORGANIZATION.

I confirm that I have read and fully understand this waiver and release of liability. I sign this waiver and release of liability voluntarily without any inducement, assurance, or warranty being made to me.
